Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)? I was hit by a woman in a parking lot. In Texas where I live, certain parking lots are no fault zones if they are private property. I was in one of these no fault zones. I was uninsured at the time. She had Uninsured Motorist Protection as part of her insurance policy. I suffered no damages to my vehicle or person. She suffered $1500 worth of vehicular damage. Her insurance company paid for her damages. I was backing out of a parking space and she came flying around the corner and messed up the entire passenger door of her car on my rear bumper. Like I said I received no damage to my vehicle since I was the one barely moving. She called the police immediately after this minor accident took place. I was not cited on the ticket I received for any accident, only for no insurance. The officer informed me verbally that the accident was my fault only because she had the right of way but that there was nothing they could do about it because of the no fault zone policy. Anyway, now her insurance company is coming after me to collect payment of the $1500 they paid for her damages. I have not agreed to pay this amount because it was a no fault zone and I don't feel I should pay for it. She should not have been going that fast in a busy parking lot with a car full of kids. Although the unofficial technicality states that I was at fault, legally no one was at fault. Her insurance company is also threatening to have my license suspended if I do not pay the amount specified. I did not think that they, as a private company, had the power to have that happen. I've never been in this situation before and need an answer as to whether or not the insurance company can do that or if its just some kind of scare tactic to jolt me into paying but really has no merit behind it. Someone please help!

I bought a car in Aug 09. It's under my dads name for cheaper insurance purpose. But I never really got to the insurance part and have been driving w/out it. CAR ACCIDENT WHOS AT FAULT AND DO WE HAVE TO GO THROUGH INSURANCE?

I was in a car accident yesterday a very minor one, the damage to my mother in laws BMW was just a cracked head light, and damage to theres was hardly apparent although the man said there was a tiny bump in door and a scratch. what happened was i was leaving a duel carriageway and on the side lane one lane was closed and a cone was in the road i swerved to miss going into work access (plenty of room as cones missing ETC cos of bad weather) then i pulled straight back out into correct lane having dragged the cone and seeming to leave it in work access... although all this happened in matter of seconds when i pulled back out i have hit the car that was originally behind me in the side door he obviously didn't break in time to stop when i swerved... i have a feeling because it was me that hit him that i am at fault? problem is i don't want to really go through insurance as it means both me and my mother in law will lose our no claims and because it was me driving not my mother in law excess is 600 as i am only a named driver.... I would rather just pay for damages if i am at fault than give my mother in law all the hassle...how much do you think it will cost? only thing is when i said this to the man he said he needs to notify insurance anyway and mine which i have been told will lose our no claims anyway... any ideas info please as im quite confused?

so, i went onto the website with the annoying singing fat man, got a reasonable quote for my classic car, declared all cars in my household, one of which is a company car with 2 years NCB. Paid the deposit and remainder was to be paid monthly by direct debit. After a couple of weeks now they've written to me wanting proof of the NCB I stated, wanting details of the previous insurance and policy number. So, I email them (as they stated in the letter that this would be the quickest way to resolve and avoid having my policy cancelled) saying the NCB was on company insurance rather than another private insurance which i think they assume I have (the option on NCB on the website included NCB on company cars), no response to my email, so I send another, now I've had a red coloured letter threatening cancellation of my insurance unless I provide the information. Tried phoning and it's either constantly engaged or answer phone. Emailed for a third and final time and put a copy of the email in the post with no response. I feel I have been totally mislead by assuming I have NCB on my company car policy, so, should they decide to cancel my policy can I get my deposit and 1st month's payment back? Citizens advice has told me that the policy was misleading and was not as described so I should be due a refund but how can I expect to get this if I cannot contact them? HELP and advice please!

I just graduated with a bachelors degree, and my student health insurance runs out in August. The health insurance offered by my husbands job (which won't open up to me until Jan.1 anyway) considers pregnancy a pre existing condition, and won't cover it. We have been searching for affordable plans, but the only ones we have found that will cover pregnancy aren't accepted in New York state. For all the plans offered in NY that we've been able to find, none cover pregnancies in progress. I would hate to have to use the state provided health care plan for pregnant mothers (mostly because I feel like there is no reason for me to be part of a government program when we are capable of paying for our own insurance, but also because it means we have to go to specific clinics and I won't be able to keep my doctor), but there is no way we will be able to cover all the costs of a birth, especially if for some reason I need a C-Section or the like. Can anyone give me some advice, especially as it relates to the NY state health plan for pregnant women?

The accident happened on a roundabout I was already on, someone pulled out on me and I T-boned the side of their car. An 'independent' assessor has looked at my car and wrote a damage report which went to the other drivers insurance company (who I am personally claiming from as my insurance is 3rd party cover only). The problem is that insurance companies have no incentive to reduce insurance premiums. They continue to get record profits and this issue is out of control.
